  1. The client expressly waives their own general terms and conditions of sale, even if these have been established after the present general terms and conditions of sale. To be valid, any deviation must be subject to a prior express and written agreement.
  2. Our invoices are payable within 21 business days, unless otherwise indicated on the invoice or purchase order. In case of non-payment by the due date, WE STANCE S.A. R.L. reserves the right to request the payment of flat-rate interest of 10% of the remaining amount due. WE STANCE S.A. R.L. will be authorized to suspend any service provision without notice in case of late payment.
  3. If a payment remains unpaid more than sixty (60) days after the due date, WE STANCE S.A R.L. reserves the right to engage a collection agency. All legal fees will be the responsibility of the client.
  4. Some countries apply withholding tax on the amount of invoices, in accordance with their internal legislation. Any withholding tax will be remitted by the client to the tax authorities. Under no circumstances shall WE STANCE S.A R.L. be held responsible for costs related to the legislation of a country. The invoice amount will therefore be due to WE STANCE S.A R.L. in its entirety and does not include costs related to the legislation of the country where the client is located.
  5. WE STANCE S.A R.L. is committed to doing its best to provide efficient services within the specified deadlines. However, none of its obligations can be considered as an obligation of result. WE STANCE S.A. R.L. cannot, under any circumstances, be held liable by the client in the context of a claim for damages made against it by a final consumer.
  6. To be admissible, any claim must be notified to WE STANCE S.A. R.L. by registered letter with acknowledgment of receipt at its registered office within 8 days following the delivery of goods or the provision of services.
  7. All our contractual relationships are governed exclusively by Luxembourg law.
  8. Promotion rights and respect for privacy: The photographer reserves the right to use the images taken for the order for professional promotional purposes. These uses may occur on various digital channels (website, social media) or physical channels (exhibitions, printed marketing materials, contests). The photographer will inform clients in case of the use of photos in which they appear. He commits to carefully select images that do not infringe on their private sphere. Clients retain the right to review and may request a change of choice if the published photo is deemed inappropriate according to this criterion.
  9. Copyright and usage license: The photographer retains full intellectual property and copyright over all images produced. Clients benefit from a non-exclusive, irrevocable, and unlimited license in time. This license allows them to use, print, and reproduce the photos for their personal and private use only. The right to modify the images remains the exclusive property of the photographer. Any public distribution of the photos, whether on the internet or during an exhibition, must necessarily include the mention of the photographer's name. The use of the images for commercial, advertising, or profit-making purposes is strictly prohibited, unless there is a written and time-limited commercial agreement between the parties.
